By enrolling in a program, using our website, or booking services, you agree to the following terms:

1. Enrollment & Eligibility
​

STUDENT MEDICAL STATEMENT ? QUESTIONNAIRE
-
All divers must provide a completed and signed Student Medical Statement to participate in any scuba diving activity.
-
It is the student’s sole responsibility to answer all questions on the Student Medical Statement truthfully and to assess their fitness for scuba diving according to the form above. Students should seek a medical opinion if they have any questions about their fitness to participate or obtain a medical clearance from a licensed physician. If the student is a physician, the medical clearance must be obtained from another qualified medical professional.

Should medical approval be required, your the medical professional must mark the form either Approved or Not Approved. If a medical professional imposes limitations to your participation in scuba diving diving professionals will consider you NOT APPROVED. Therefore, no limits or conditions for participation in scuba diving activities are acceptable. ( PADI Resource)

By enrolling in a program, you confirm that you have reviewed the medical statement and are medically fit to participate.

Important: If you enroll without reviewing the statement and later find you are not medically fit, no refunds will be issued.

Understand and agree to the Inherit Risks Involved with SCUBA Diving: You may view the Liability Forms Required for Participation

Students must abide by all requirements and rules of the specific program in which they are enrolled, including age, skill level, and safety prerequisites.

Divers under 8 years old may not participate in scuba activities; divers under 10 years old may not enroll in certification courses.

2. Fees, Payments & Refunds
-
All program fees, payments, and enrollments are non-refundable.
-
Payments for services, programs, and related items are final.
-
Unused store items may be exchanged for store credit within 20 days if unused, with original receipt and packaging.
-
Certain items, including books, e-courses, CDs, and DVDs, cannot be returned once opened.

3. Transfers & Rescheduling
-
Instructional programs may be transferred to another eligible participant before completion of the program. Transfers must cover costs of any program segments already completed by prior student.
-
All participants in a transfer agree to all Terms & Conditions outlined by DiVE KS.
-
Rescheduling requires a minimum 48-hour notice for most programs; some require 72 hours. Failure to provide notice will incur additional fees.
-
No-shows for any session result in forfeiture of tuition; rescheduling requires payment of the full tuition fee.
- All SCUBA programs are progressive, and all sessions must be attended in the designated order. If a scheduled session is missed without proper notice, students will be required to pay any applicable additional fees. After that, students may choose to either:

Schedule a private session with applicable private fees, or
-
Wait for the next available group session with open spots.'​

4. Open Enrollment
DiVE KS offers open enrollment, allowing students to enroll at any time. We will form a schedule based on the student’s availability or group them with other students who have similar availability.

If a student’s availability becomes more restrictive than initially discussed, the student will be responsible for any applicable private session fees required to complete the program within their desired timeline.
-
Students may also enroll without a set schedule. In the event a student chooses to accelerate their program, for example due to travel or personal timeline changes, they will be responsible for any private session fees necessary to complete the program within their requested timeframe.

These fees apply only when the student requests scheduling outside of standard group sessions, accelerates their program beyond the planned schedule or has extremely restrictive availability that requires personalized training schedule.

5. Private Classes

DiVE KS offers private classes, which may be conducted as one-on-one sessions or private group sessions at one of our pool facilities or, if applicable, at your home pool.

Fees: Private classes are in addition to standard course tuition. Fees are calculated per person, per hour.

Instructor Fee: $200 per person, per hour
-
Pool Fee: $60 per hour
-

Private classes may be scheduled to accommodate students’ availability or to accelerate program completion, and all private sessions must be confirmed in advance with DiVE KS.

6. Training Time Limits
-
Confined Water Sessions must be completed within 1 year of eLearning completion.
-
Open Water dives must be completed within 1 year of Confined Water completion; additional fees apply for required review sessions.
-
Referrals must be completed within 1 year; no exceptions.

7. Travel Bookings
-
All independent and Executive travel bookings through DiVE KS are subject to a booking fee.
-
All payments for travel bookings, excursions, or dive trips are non-refundable.
​
8. Safety & Liability
-
Scuba diving involves inherent risks. All participants must sign a Liability Release Form prior to participation.
-
Equipment use and participation are at the diver’s own risk.
-
DiVE KS is not liable for personal injury, illness, or other incidents during diving activities.
​
7. Intellectual Property
-
All website content, images, and course materials are property of DiVE KS or our partners.
-
Unauthorized use or reproduction is prohibited.
​
8. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts. Any disputes will be resolved in the courts of Massachusetts.

9. Severability
If any part of these Terms & Conditions is found invalid or unenforceable, the remaining provisions remain in full effect.
​
10. Force Majeure
DiVE KS is not responsible for delays, cancellations, or failure to perform due to events beyond our reasonable control, including natural disasters, acts of government, or other unforeseeable circumstances.

11. Marketing & Communications
By enrolling or providing your contact information, you consent to receive emails or communications regarding programs, services, and promotions. You may opt out at any time.
